Korea Medical Hub website (hereinafter referred to as KMH or KMH website) provides a list of clinics and hospitals in Korea (hereinafter referred to as HEALTHCARE PROVIDERS or They) and their information, 1:1 Medical Tour Coordinating Service (hereinafter referred to as KMH SERIVCE) and Pre-Packaged Medical Tour Program (hereinafter referred to as KMH Package). KMH is owned and operated by KMH Team(hereinafter referred to as KMH Team, KMH or we). By using KMH in any way, you are agreed to comply with the following Terms of Use. Should you object to any terms or conditions of this Terms of Use, any guidelines, or any subsequent modifications thereto or become dissatisfied with KMH in any way, your only recourse is to discontinue the use of KMH website immediately. KMH has the right to strictly enforce the Terms of Use through community moderation, active investigation, litigation and prosecution.
KMH reserves the right, at our sole discretion, to change, modify or otherwise alter these terms and conditions at any time. Such modifications shall become effective immediately upon posting thereof. You must review this agreement on a regular basis to keep yourself apprised of any changes. 3.1 KMH provides information of HEALTHCARE PROVIDERS by their specialty and location who wish to provide medical services for foreign patients. KMH Team provides a portal hub to connect patients or users (hereinafter referred to as CLIENTS or You) and HEALTHCARE PROVIDERS though KMH website. For the purpose of these Terms of Use, "Medical Services" means the medical service or any other services that HEALTHCARE PROVIDERS are legally permitted to provide to you.
3.2 KMH provides information of HEALTHCARE PROVIDERS in Korea about their facilities and Medical Services via KMH website. This information is intended to assist CLIENTS in making a decision on choosing HEALTHCARE PROVIDERS by conducting your own research. Once you decide on HEALTHCARE PROVIDERS you want to contact for a consultation, KMH facilitates online contact between CLIENTS and HEALTHCARE PROVIDERS by providing information you agree to disclose to them.
3.3 KMH SERVICE for 1:1 Medical Tour Coordinating Service and KMH PACKAGES - Pre-Packaged Medical Tour Programs are provided by KMH with its affiliated clinics, hospitals and other hospitality businesses in Korea via online request form CLIENTS submitted through KMH website, phone or email. The information provided by CLIENTS to use KMH SERVICE & PACKAGES are confidential and protected and regulated by our Privacy Statement. CLIENTS using KMH SERVICE & PACKAGES are subject to pay for the service rendered to KMH Team according to Terms of Payment. 3.4 KMH Team performs following inspection on HEALTHCARE PROVIDERS listed in KMH website to ensure quality information for CLIENTS and award KMH certification:
- Availability of official website in English
- Availability of English speaking medical staff
- Registration to provide medical service for international patients (by the Ministry of Health & Welfare)
- At least of 50 customer reviews with over 4-star rating.
3.2 KMH provides information of HEALTHCARE PROVIDERS in Korea about their facilities and Medical Services via KMH website. This information is intended to assist CLIENTS in making a decision on choosing HEALTHCARE PROVIDERS by conducting your own research. 4.1 KMH Team is not involved in any transaction between CLIENTS and HEALTHCARE PROVIDERS who use KMH website. We cannot assure that all transactions will be completed nor do we guarantee the ability or intent of HEALTHCARE PROVIDERS to fulfill their obligations in any transactions.
4.2 KMH Team cannot guarantee or endorse authenticity, quality, safety or legality of the information provided by HEALTHCARE PROVIDERS.
4.3 KMH Team does not provide medical referral service for CLIENTS inquiry made directly to HEALTHCARE PROVIDERS, and is not responsible for any medical malpractice or dispute.
4.2 KMH Team cannot guarantee or endorse authenticity, quality, safety or legality of the information provided by HEALTHCARE PROVIDERS.
4.3 KMH Team does not provide medical referral service for CLIENTS inquiry made directly to HEALTHCARE PROVIDERS, and is not responsible for any medical malpractice or dispute.

Such information is provided for informational purposes only and is not meant to be a substitute for a doctor's iagnosis. CLIENTS should not use the information contained herein for diagnosing their health conditions or diseases. CLIENTS should always consult with a doctor.
5.2 Virtual Estimate
Virtual Estimate is intended to provide average price range of medical procedures done by HEALTHCARE PROVIDERS in Korea. It does not represent nor guarantee actual cost of a particular procedure at the specific HEALTHCARE PROVIDERS listed in KMH website.
5.3 KMH Service & KMH Packages
Authorized medical coordinators of Korea Medical Hub provide 1:1 medical tour coordinating service - KMH Service - to provide complete customized travel & medical treatment itinerary in Korea upon the submission of Service Request from CLIENTS via phone, email or online request through KMH website. Upon requesting KMH Service, CLIENTS agree to use the Service at your own risk. The information CLIENTS submitted for KMH SERVICE is confidential and will be protected accordingly based upon a Privacy Policy, which can be found at the following address:

KMH Team shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any content that is available on KMH website. KMH Team may also change, suspend or discontinue any aspect of KMH at any time including the availability of any features, database, or content. KMH Team also may impose limits on certain features and services or restrict your access to parts or entire KMH website without notice or liability.
7.1 Find Clinic
Information about clinics & hospitals on the Find Clinic menu is provided by HEALTHCARE PROVIDERS. KMH Team makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in KMH website. Medical Services offered or performed by HEALTHCARE PROVIDERS may, in its sole discretion, change, suspend or discontinue without prior notice to CLIENTS. Any modifications on Medical Services are effective immediately upon posting thereof.
7.2. Third Party Websites and Links
KMH may contain features and functionalities that may link you or provide you with access to third party content which is completely independent of KMH website, including websites, directories, servers, networks, systems, information, database, applications, software, programs, products or services. Your interaction with organizations and/or individuals found on or through KMH website, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, is solely between you and such organizations and /or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties.

CLIENTS agree not to post, email, or otherwise make available content:
a) that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
b) that is pornographic or depicts a human being engaged in actual sexual conduct, bestiality, masturbation, sadistic or masochistic abuse, or lascivious exhibition of genitals or pubic area of any person.
c) that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
d) that impersonates any person or entity, including, but not limited to, KMH Team employees, or falsely states or otherwise misrepresents your affiliation with a person or entity;
e) that includes personal or identifying information about another person without that person's explicit consent;
f) that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch";
g) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
h) that constitutes or contains "junk mail", "spam", "chain letters", "pyramid schemes", or "unsolicited commercial advertisement";
i) that advertises any illegal service or the sale of any items which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by the government of Korea.
j) that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware;
k) that disrupts the normal flow of dialogue with an excessive amount of content (flooding attack) to KMH, or that otherwise negatively affects other users' ability to use KMH website;
l) that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through KMH website;
Additionally, CLIENTS agree not to:
m) contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
n) "stalk" or otherwise harass anyone;
o) collect personal data about other users for commercial or unlawful purposes;
p) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data - unless expressly permitted by KMH Team;
q) post irrelevant content, repeatedly post the same or similar content or otherwise impose an unreasonable or disproportionately large load on KMH infrastructure;
r) post the same content more than one classified category;
s) attempt to gain unauthorized access to KMH administrative systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the service of KMH website;
t) use any form of automated device or program that enables the submission of postings on KMH website without each posting being manually entered by the author to submit postings in bulk, or for automatic submission of postings at regular intervals;
a) that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way;
b) that is pornographic or depicts a human being engaged in actual sexual conduct, bestiality, masturbation, sadistic or masochistic abuse, or lascivious exhibition of genitals or pubic area of any person.

Your use of KMH website, service or packages and Medical Services of HEALTHCARE PROVIDERS signifies acknowledgement of and agreement to our Privacy Policy. CLIENTS further acknowledge and agree that KMH Team may, in its sole discretion, preserve or isclose your content, as well as your information, such as email address, IP address, timestamps, and other user information, if required to do so by law or in the good faith that such preservation or disclosure is reasonably necessary to:
- comply with legal process
- enforce the Terms of Use
- respond to claims that any content violates the rights of third-parties
- respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment

Your use of KMH website, service or packages and Medical Services of HEALTHCARE PROVIDERS signifies acknowledgement of and agreement to our Privacy Policy. CLIENTS further acknowledge and agree that KMH Team may, in its sole discretion, preserve or isclose your content, as well as your information, such as email address, IP address, timestamps, and other user information, if required to do so by law or in the good faith that such preservation or disclosure is reasonably necessary to:
- comply with legal process
- enforce the Terms of Use
- respond to claims that any content violates the rights of third-parties
- respond to claims that contact information of a third-party has been posted or transmitted without their consent or as a form of harassment
- protect the rights, property, or other CLIENTS or the general public
KMH Team may at any time, without notice to CLIENTS, suspend or terminate the access to KMH website, or any service forming part of KMH, wholly or partially for any reason, including without limitation, where you have provided false or misleading information, or you are in breach of these Terms of Use, or if KMH Team cannot verify or authenticate any information submitted to KMH website. KMH Team is not liable to CLIENTS or any third party for any suspension or termination of access to KMH website.
CLIENTS agree that use of KMH website, service, packages and Medical Services of HEALTHCARE PROVIDERS is entirely at your own risk. KMH website, service, packages and Medical Service of HEALTHCARE PROVIDERS are provided on an "AS IS" or "AS AVAILABLE" basis, without any warranties of any kind. All information provided on KMH website is intended as a guide only and should not be construed as a substitute for professional medical advice and KMH Team makes no representations, warranties or undertakings as to the accuracy of any information provided on KMH website. KMH Team makes no representations, warranties or undertakings that KMH website, or the server that makes it available, will be free from defects, including, but not limited to viruses or other harmful elements. To the maximum extent permitted by applicable law, KMH Team accepts no liability for any infection by computer virus, bug, tampering, unauthorized access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any event or occurrence beyond the control of KMH Team, which corrupts or affects the administration, security, fairness and the integrity or proper conduct of any aspect of KMH website. All use by CLIENTS of KMH website is at your own risk. CLIENTS assume complete responsibility for, and for all risk of loss resulting from, your downloading or using of, or referring to or relying on the facilities, service, materials or products provided on KMH website, or any other information obtained from your use of KMH. CLIENTS agree that, to the maximum extent permitted by applicable law, KMH Team and providers of telecommunications and network services to KMH website will not be liable for damages arising out of your use or your inability to use KMH website, and CLIENTS hereby waive any and all claims with respect thereto, whether based on contract, tort or other grounds. No advice or information, whether oral or written, obtained by CLIENTS from KMH Team shall be deemed to alter this disclaimer of warranty, or to create any warranty.
Under no circumstances shall KMH Team be liable for direct, indirect, incidental, special, consequential or exemplary damage, resulting from any aspect of your use of KMH, service, packages and Medical Services of HEALTHCARE PROVIDERS, whether the damages arise from use or misuse of KMH website, service, packages and Medical Services, from inability to use KMH website, service, packages and Medical Service, or the interruption, suspension, modification, alteration, or termination of KMH website, service, packages and Medical Services. Such limitation shall also apply with respect to damages incurred by reason of other services or advertised in connection with KMH website, service, packages and Medical Services, or any links on the KMH website, as well as by reason of any information or advice received through or advertised in connection with the KMH website, service, packages and Medical Services, or any links on KMH website. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to CLIENTS.
Subject to any applicable terms and conditions set forth in our privacy policy, any communication or other materials that CLIENTS send us through the internet such as any questions, comments, or suggestions will be deemed to be non-confidential and KMH Team shall have no obligation of any kind with respect to such information. KMH Team shall be free to use any ideas, concepts, know-how or techniques contained in such communication for any purpose whatsoever, including but not limited to, developing, enhancing and marketing services.
KMH including Korea Medical Hub logo, kmhglobal.com, its family sites, and all related logos (collectively "The Korea Medical Hub Trademarks") are trademarks or service marks of KMH owned and operated by KMH Team. Other companies, products, service names and logos used and displayed on KMH website may be trademarks or service marks owned by KMH Team or its affiliated companies. Nothing on KMH website should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any of the KMH Trademarks displayed on KMH website, without prior written permission in each instance.
10.1 The information, content, graphics, text, images, trademarks, service marks, domain names, rights in good will, know-how, designs and rights in designs, trade name and logos (whether registered or unregistered) contained in this website are protected by copyright, trade mark, database right, and other intellectual property laws and are also protected under national laws and international treaties. KMH Team retains all right, title, interest and intellectual property rights in and to the materials.
10.2 Any other use of the materials on KMH website, including any form of copying or reproduction, modification, distribution, uploading, re-publication, extraction, or integration with other materials or works without the prior permission of KMH Team is strictly prohibited and is a violation of the proprietary rights of KMH Team.
10.3 CLIENTS agree to grant KMH Team a non-exclusive, royalty free, world-wide, transferable perpetual license with the right to sub-license, reproduce, distribute transmit, create derivative works of, publicly display and perform any materials and other information (including without limitation ideas contained therein for new or improved services) you submit to KMH website either during the registration process or otherwise, including any information or materials you post to a community board, and comment & review sections on KMH website.
10.2 Any other use of the materials on KMH website, including any form of copying or reproduction, modification, distribution, uploading, re-publication, extraction, or integration with other materials or works without the prior permission of KMH Team is strictly prohibited and is a violation of the proprietary rights of KMH Team.
10.3 CLIENTS agree to grant KMH Team a non-exclusive, royalty free, world-wide, transferable perpetual license with the right to sub-license, reproduce, distribute transmit, create derivative works of, publicly display and perform any materials and other information (including without limitation ideas contained therein for new or improved services) you submit to KMH website either during the registration process or otherwise, including any information or materials you post to a community board, and comment & review sections on KMH website.
Any waiver of any provision of these Terms of Use must be in writing signed by KMH Team to be valid. Any waiver of any provisions hereunder shall not operate as a waiver of any other provisions or a continuing waiver of any provisions in the future. Each of the provisions of these Terms of Use is separate and severable and enforceable accordingly and if at any time any provision is judged by any court of competent jurisdiction to be void or unenforceable. The validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. Nothing in these Terms of Use shall constitute, or be deemed to constitute, a partnership between CLIENTS and KMH Team, nor shall either party be deemed to be the agent of the other party. These Terms of Use represent the entire understanding and agreement between CLIENTS and KMH Team relating to use of KMH website, its facilities and/or services (including website service) and supersede any and all prior statements, understandings and agreements.
